TERMS AND CONDITIONS OF THE COMPETITION - PLEASE READ THE RULES CAREFULLY AND ONLY ENTER THE COMPETITION IF YOU AGREE TO THE TERMS AND CONDITIONS SET OUT HERE.
1. THE GAME ORGANISER
The competition „Zalakaros Spa - SPRING APPLICATION 2024” (hereinafter referred to as the ”Game”) is organised and operated by Zalakaros Family, Experience and Spa Ltd. (Address: 8749 Zalakaros, Termál út 4., Tax ID: 11341019-2-20), zkf.hu (hereinafter referred to as the ”Organiser”).
2. CONDITIONS OF PARTICIPATION
2.1 The Game is open only to Hungarian citizens over the age of 18 years, who are residents or residents of Hungary and hold a valid identity card issued by the Hungarian authorities, and who are not persons as defined in Section 2.3, and who are capable of acting (”Player” or ”Participant”), who are eligible to participate in the Game, in accordance with the terms of the Game 3. (a) agrees to all the terms and conditions set out in these Rules of the Game (”Game Rules”) and consents to the processing of the personal data (full name, Facebook ID, age) provided to the Organiser by liking the post on the Zalakaros Spa Fan Page - provided during the Facebook registration - in connection with the Game as described in Section 7 (hereinafter collectively referred to as ”Application”).
2.2 Excluded from the Game are the employees of Zalakaros Family, Experience and Spa Ltd. and Zalakaros Spa and these persons are subject to the provisions of the Civil Code. 8:1.§ (1) point 1 of the Civil Code, as well as other direct contributors to the Game and their close relatives.
2.3 Players will be identified by the information they provide when liking a Fan Page post. The Promoter or the Promoter acting on its behalf shall not be liable for any technical problems (in particular, but not limited to, changes to data, deletion of Facebook profile, etc.) arising from any changes to the data that are outside the control of the Promoter.
2.4 Entries that do not comply with the formal and substantive requirements set out in the Rules of the Game will be automatically disqualified from the Game, while valid Entries will be computer-recorded.
2.5 The Promoter will automatically disqualify participants who provide false information from the Game.
2.6 The Promoter will only consider valid those Entries that are submitted to the Game through the Player's own Facebook profile registered by the Player. If the Player does not use a Facebook profile registered by him/herself, the Organiser and the Promoter exclude all liability in connection with any disputes arising from the right to use an e-mail account or Facebook profile in connection with the Game.
2.7 By submitting an Entry, the Player acknowledges that the content, performance, message and data transmission and response speeds of the technical infrastructure of the Game are dependent on the server technology and may be adversely affected by factors beyond the control of the Promoter, such as (but not limited to) connection failure, server computer performance, network congestion, network congestion, coverage and the maintenance of a secure network connection. The Promoter and the Promoter exclude all liability arising from this paragraph.
2.8 The Promoter may examine the Entries in order to comply with the terms and conditions of the Rules, and if they or the Player submitting them do not comply with the terms and conditions of the Rules for any reason, the Player concerned may be disqualified from the Game.
2.9 Players who, contrary to the spirit of the Game, participate in the Game in a team under the name of a natural person, or with mass-generated email addresses, Facebook profiles or Facebook profiles containing non-existent persons, with the aim of increasing their chances of winning by such deceptive behaviour, may be excluded from the Game at the discretion of the Promoter. Such players include, for example, persons who associate to participate in sweepstakes and other contests, coordinate their actions to win prizes and combine the performances of several persons under one name, thereby depriving other players who wish to play fairly of their chances of winning. Such persons shall also include those who participate in the Game with false information or with a false Facebook profile in order to unfairly increase their chances of winning. Participants or players who engage in unfair conduct as defined in this clause shall be liable to compensate the Promoter and/or the Promoter for any damage caused to them in connection with the Game.
3. DURATION OF THE GAME
The Game from 09.August 2024.12:00 until 19.August 2024.12:00
4. HOW THE GAME WORKS
4.1 On the Facebook Fan page of Zalakaros Spa, a post inviting to a prize draw will be published on 09 August 2024, at 12:00 pm.

5.1 Winnings:
- 1 family ticket for 2 adults and 2 students
5.2 Prizes are not redeemable for cash.
6. NOTIFICATION OF WINNERS, PRIZE AWARD
The Promoter will notify the winners of the result of the Game after the draw as described in clause 5.1 using one of the contact details provided. If the Winning Player does not respond to the Notification, he/she will no longer be entitled to the Prize and the Promoter shall be entitled to award the Prizes to the Reserve Winners.
6.1 Winnings can be collected by the Players electronically or on the spot. The winning Player shall cooperate in order to ensure that the prize is delivered no later than the deadline specified in this clause. The Promoter will be able to arrange collection of the Prizes within this deadline. If the Winning Player fails to comply with this obligation to cooperate, and thus the delivery of the Prizes within the time limit set out in this clause is not possible, the Organiser shall not be held liable for this. The Promoter will not be able to provide another opportunity to collect the prize. The Promoter reserves the right to transfer any prize not collected for any reason to the reserve winners.
6.2 The Organizer shall exclude from the Game any Contest for which the Prize cannot be delivered or given to the Player who submitted it because the personal data provided in the Contest or in the confirmation of the Notification are not true, incomplete or incorrect, or the Player who submitted the Contest does not meet the personal requirements described in these Rules for any other reason, in particular, the Player is under the age of 18. The Promoter shall not be held liable for any damage resulting from incorrect information provided by the Player.
7. TAXATION, COSTS
Any tax liability associated with the Prize is borne by the Promoter. The Promoter shall have no further obligations other than the delivery of the Prizes as described above, the provision of the service and the payment of the tax. Any other costs incurred (e.g. travel expenses) shall be borne by the winning player.
8. DATA PROTECTION, PERSONAL RIGHTS
8.1 The provision of the information described in these Rules is voluntary. Those who participate in the Game acknowledge and expressly consent that 8.1.1 the Organiser, as data controller and data processor, may process the personal data provided by them exclusively in connection with the Game, as described in this clause, for the duration of the Game;
8.1.2 in the event of winning, the Promoter will disclose their name and Facebook profile picture without any further conditions or consideration, solely in connection with the Game;
8.1.3 to record images, audio and film footage of the Players and the Prize delivery, which the Promoter may use in whole or in part in the promotion and advertising of the Promoter's products and services without any further consent or consideration, in full respect of the rights of privacy; and
8.1.4 by participating, expressly agree to all provisions of the Game Rules in all respects.
8.1.5 The Organiser warrants that the data will be processed in compliance with all applicable legal provisions. The Organiser shall provide the Player at any time with the opportunity to request information on the processing of his personal data, to request their deletion or rectification at the marketing@zkf.hu at. In addition, the Player has the right to object to the processing of their personal data. If the Player does not agree with the decision taken by the Organiser on the basis of his/her objection, he/she may appeal to the courts. The controller of the personal data provided is.
8.2 If the Player requests the deletion of his/her personal data during the duration of the Game, he/she acknowledges that he/she will lose all rights in the Game and will be disqualified from the Game.
9. MIXED PROVISIONS
9.1 The Promoter accepts no liability for any omission/error in the Entries (e.g. misspelling, misspelling of address, incorrect or untrue information, etc.), for any delay or failure to deliver the Prize or for any damage caused during delivery.
9.2 If the winning Player does not collect his/her Prize, he/she may no longer claim it from the Promoter.
9.3 The Organiser excludes all liability for any external attacks on www.facebook.com and the server hosting it, so-called SQL attacks. Thus, if as a result of an attack on the website or the server, players receive incorrect system messages regarding their prizes, winner/non-winner status, etc., the Promoter shall not be liable for such cases.
9.4 If the player closes the browser window while submitting an Entry (sharing an entry) or if the connection (for any reason) to the server's website is lost, the Promoter will not be liable for any loss of data.
9.5 The Promoter disclaims any liability for any failure of the Website or Facebook Fan Page due to causes beyond its control, during which time the Website or Facebook Fan Page is unavailable or restricted, but will take all necessary steps to promptly investigate and remedy the cause of the failure.
9.6 The Game is in no way sponsored by or affiliated with Facebook. The data is not provided to Facebook but to the Promoter.
9.7 The Promoter reserves the right to modify the terms and conditions of the Game without giving any reason, including the termination of the Game. The Organiser will publish the relevant information with the same publicity as other announcements in the Game.
